Please read this carefully when making a reservation or request at Fresh Escapes.
Executive Summary
Booking & Payment: You book through Fresh Escapes acting as agent for
property owners. A deposit and a booking fee are payable at booking; the
balance is due by the specified date. The Booking Fee/Service Fee is non-
refundable. We will email you confirmation once your payment is processed and
the booking is accepted by the owner.
Damage Protection: Properties may require a Damage Deposit (refundable) or
offer an optional Damage Waiver (non-refundable fee), as stated in your
booking. The Damage Deposit is returned (less any deductions) within 7 days
after checkout. The Damage Waiver covers accidental damage up to a limit; it is
not insurance and excludes intentional or pet damage. A comparison table is
provided below.
Cancellation: You generally have no right to cancel after booking (our Booking
Service is completed). We will confirm all details on booking, so please check
them carefully. In exceptional cases (e.g. government travel restrictions), we may
allow cancellation or rescheduling as set out below. Transferring a booking to
another person is not permitted.
Use of Property: The property is for your holiday use only. You and your party
(including any pets) must follow the owner’s rules, leave the property clean,
report any damage immediately, and vacate at the agreed times. A full section
on Guests’ Responsibilities and Hot Tub Safety is included.
Liability & Insurance: We act only as agent and are not responsible for the
property’s condition or the owner’s performance. Your personal belongings are
left at your own risk. We recommend you take out travel insurance. Our liability
(and the owner’s liability) is limited as allowed by UK law.
Privacy & Marketing: We collect and use your personal data according to our
Privacy and Cookie Policies (see website). We will ask if you consent to receive
marketing communications (emails or calls about offers). You can withdraw
consent any time without affecting your booking.
Governing Law & Contact: These terms are governed by English law. Disputes
can be dealt with in English courts (or Scottish/Northern Irish courts if you live
there). Our contact details are at the end of this document.
1. Booking, Payments and Confirmation
1. Eligibility: To make a booking, you must be at least 18 years old, have legal
capacity, and provide truthful, up-to-date information. You must register on our
Site or give us your details by phone, including name, email, and phone number.
2. How to Book: You can book via our website or by contacting us (phone/email).
On our website, select the Property and dates, then proceed through the booking
process. For phone or email enquiries, we will guide you to complete the booking
on the Site or arrange payment directly. Before finalising, you will have the
chance to review all details and these terms.
3. Deposits and Fees: At booking you will pay: the Booking Fee (our service fee,
non-refundable) and either the Deposit (initial payment toward the Rental
Charges) or the Damage Waiver fee if you opt for that (see section 4). Any
additional mandatory fees (e.g. heating supplement, pet fee) will be shown
before you pay. All amounts are in pounds sterling (unless stated) and exclude
VAT unless noted. We apply the price shown at booking; if we discover an error,
we will correct it as follows: if the actual cost is lower, you pay the lower price; if
higher, we will contact you to accept the new price or cancel. We will not charge
you without your consent.
4. Final Balance: If only a deposit is paid at booking, the remaining Rental
Balance is due by the date specified in your Booking Confirmation (usually 6–8
weeks before arrival). If you authorised card payment, we will charge the balance
automatically on the due date. Otherwise, you must pay via our website or bank
transfer by that date. If payment is not made by the due date, we may charge
interest at 4% above the Bank of England base rate daily until paid, and may
cancel the booking.
5. Payment Methods: We accept most major credit/debit cards and bank transfers.
You may select your currency (if offered), in which case the exchange rate we
use will be fixed at booking. If exchange rate changes cause your balance due to
increase by 5% or more by the payment date, we may adjust your payment. If
this happens, we will notify you and you may cancel within 14 days of that notice
with a full refund of sums paid. Payment details must match the name on the
booking; we reserve the right to refuse or cancel any booking made with
fraudulent or disputed payments.
6. Booking Confirmation: Once we have received your payment (Deposit and
Booking Fee), we will check the property’s availability. If the property is available,
we will send a Booking Confirmation by email, including these terms and your
Booking Details. The contract for the Rental Services is formed at that point
between you and the owner. The Booking Service contract between you and
Fresh Escapes is also formed then. If the property cannot be provided (e.g.
double-booked), we will notify you and refund all monies paid.
7. Booking Fee: The Booking Fee covers our arranging the booking and is non-
refundable once your booking is confirmed. The Deposit and any Damage
Waiver fee are handled as described below.
2. Key Definitions
Property: The holiday accommodation (cottage, villa, etc.) you have booked.
Owner: The legal owner of the Property (or their authorised manager).
Booking Service: The service provided by Fresh Escapes to arrange your
booking. Fresh Escapes is an agent for the Owner.
Rental Contract: The contract for the rental of the Property, between you and
the Owner, which comes into effect on booking confirmation.
Booking Fee (Service Fee): Our fee for facilitating the booking. (Non-refundable
once booking is confirmed.)
Deposit: The initial payment toward the total Rental Charges (often a percentage
of the total price).
Rental Balance: The remaining payment due after the Deposit.
Damage Deposit: A refundable security deposit held to cover any damage or
excessive cleaning required due to your stay.
Damage Waiver: An optional, non-refundable fee you may pay (where offered) in
lieu of a security deposit, covering accidental damage up to a set amount.
Guests: The people you book in addition to yourself (such as family members or
friends staying in the Property under your booking).
Holiday Period: The dates for which you have booked the Property (arrival and
departure dates).
3. Our Role and the Rental Contract
We act only as agent for the Owner. When we confirm your booking, we do so
on the Owner’s behalf. The contract for the Property rental is between you and
the Owner. However, in arranging the booking and taking your payments
(Deposit, balance, fees), we act as agent and collect funds on the Owner’s
behalf.
The Rental Contract includes your Booking Details, these Booking Terms, and
any special conditions we draw to your attention during booking. Please read
them all carefully.
No Recommendation: Inclusion of a Property on our Site is not an endorsement
by us. We do not inspect properties ourselves (unless stated); descriptions and
ratings come from Owners or public sources. We are not liable if a property is not
of the expected standard or facilities are different/closed. Any issues with the
Property itself are matters between you and the Owner.
Non-Commercial Use: You agree to use the Property only for private holiday
purposes. You may not offer the Property or any part of it for resale or sub-rental,
or use it for events or business activities, without our and the Owner’s written
permission.
Agent’s Liability: We are responsible for providing the Booking Service with
reasonable care. However, we accept no liability for the Owner’s actions or
failures. Any complaints about the Property or rental services should be
addressed to us and, where appropriate, to the Owner. We will help liaise, but
your rights for issues in the Property are against the Owner.
4. Damage Deposit and Damage Waiver
1. Deposit vs Waiver: Each Property’s terms will specify whether a Damage
Deposit is required or a Damage Waiver is offered. If a Damage Deposit is
required, the amount and payment timing (often at booking or before check-in)
will be stated. If a Damage Waiver is offered, you may choose to pay the one-
time Waiver fee (as quoted in your Booking Confirmation) in place of a deposit.
Whether deposit or waiver applies (and the amounts involved) will be clearly
shown during booking and in your confirmation.
2. Damage Deposit: A Damage Deposit is fully refundable after your stay, within 7
days of check-out, subject to the following: after you leave, the Property will be
inspected for any damage or need for extra cleaning beyond normal. If there is
damage or missing items caused by you or your Guests, the Owner (or Fresh
Escapes on their behalf) will charge the cost of repair or replacement. We will
deduct those costs (with supporting invoices) from the deposit, and return any
remaining amount to you. We will account for any deductions. If there are no
issues, the full deposit is returned.
3. Damage Waiver: The Damage Waiver is not insurance but a prepaid protection
scheme covering accidental damage up to the specified limit. By paying the
non-refundable Damage Waiver fee, you are covered for any accidental damage
caused by you, your guests, or pets (if pets are allowed) to the Property or its contents, up to the stated waiver amount. The fee is per booking (not per person)
and is typically much lower than a large deposit. The waiver does not cover:
deliberate damage, gross negligence, loss or theft of property, damage by pets
not explicitly covered (see pet rules below), or any costs above the waiver limit.

4. Claims Process: After check-out, if damage is reported, we will handle it as
follows:
With a Deposit: We hold the deposit. If damage is found, we (on the
Owner’s behalf) will obtain estimates/invoices for repairs or replacements.
We deduct those costs from the deposit and notify you of the amounts.
The balance of the deposit (if any) is returned to you. If the damage cost
exceeds the deposit, you agree to pay the excess on demand.
With a Waiver: We will obtain the cost of damage. If the cost is within the
waiver limit, Fresh Escapes or the waiver provider will cover it, so you
have no further payment. If the cost exceeds the waiver limit, or if damage
is not covered by the waiver terms (e.g. pet damage when not covered),
you must pay the excess amount or uncovered costs. We will invoice you
for any excess.
5. Waiver Coverage: Typical items covered by the Damage Waiver include minor
accidental breakages (e.g. broken dishes, glasses, small furniture damage),
stains, and other unintended damage to the property and its
contents. Excluded items often include damage from pets (fur, urine, chewing,
unless a special pet waiver is paid), lost keys, theft of personal belongings, willful
or criminal damage, or any liability for injury. The exact terms for each waiver will
be in your Booking Confirmation.
6. Deposit Refund Timeline: If a Damage Deposit is held, we will aim to resolve
any claims and refund the balance within 7 days after the end of your stay. In
cases of waiver, there is no refund (since it is non-refundable by definition).

5. Use of the Property and Guests’ Responsibilities
You, as the lead guest, agree on behalf of yourself and all your Guests to the following:
Occupancy: Only the number of people (including children and infants) specified
in the booking may stay at the Property. No unregistered person or additional
vehicle may be added without the Owner’s permission.
Purpose: The Property is to be used only for holiday accommodation. No
commercial or illegal use is permitted.
Conduct: You and your Guests must keep the Property and neighbourhood
peaceful. You agree not to disturb neighbours, cause excessive noise, or behave
in a violent, illegal, or anti-social manner. Management reserves the right to
involve police or terminate the booking for serious disturbances.
Property Care: You must use the Property and facilities responsibly and safely.
Keep the Property clean and tidy; do not abuse or misuse any furnishings,
appliances, or amenities. Do not smoke indoors. Allow the Owner or
representatives to enter at reasonable times (with prior notice) for any legitimate
purpose (e.g. repairs, inspections).
Check-in/Check-out: Arrive no earlier than the agreed check-in time on the first
day of your Holiday Period, and depart no later than the check-out time on the
last day (unless we or the Owner agree otherwise). We will provide these times in
your booking documents. Late departures may incur additional charges.
Breakages and Damage: Report any breakages, damages, or defects to the
Owner or Fresh Escapes immediately upon discovery. You will reimburse the
Owner for the cost of repairing or replacing any items broken, lost or damaged by
you or your Guests (beyond normal wear and tear). We or the Owner may charge
you for any additional cleaning required. Payment will be collected either from the
Damage Deposit or by invoicing you after your stay.
Guest Supervision: You are responsible for supervising all children and
ensuring they obey the house rules. Any misuse of the Property by Guests or
visitors remains your responsibility. If you do not personally stay at the Property
for the entire Holiday Period, you are still responsible for all Guests (the contract
cannot be transferred to a person not originally on the booking).
Access and Security: You must return all keys or access devices as instructed.
Lost keys or security devices may result in charges for replacements or locksmith
services.
Legal Compliance: You and your Guests must obey any health and safety,
property-specific rules, or local laws (e.g. no fireworks, bonfires, etc.) that apply
to the Property or its location.
Pets: See the separate Pets section below for detailed rules.
Failure to comply with these obligations may lead the Owner (or us) to terminate the
Rental Contract (see Sections 7 and 8). In such an event, you and your Guests must
leave immediately, and no refund will be given.
Hot Tub Safety and Rules
If your Property has a hot tub, its use is subject to strict safety rules. By using the hot
tub, you agree to the following (in addition to general property rules):
Age and Supervision: Only persons aged 18 or over may use the hot tub.
Children or anyone under 18 must be supervised and assisted in and out of the
hot tub by an adult at all times.
Health Warnings: Guests with heart conditions, pregnant guests, or anyone with
medical concerns should consult a doctor before use. Do not enter the hot tub if
under the influence of alcohol or drugs, or if feeling unwell.
Alcohol and Drugs: Drinking alcohol or taking drugs while in the hot tub is
prohibited, as it can impair judgment and increase risk of accident or drowning.
Hygiene: Shower before entering to help keep the water clean. Do not use the
hot tub with soaps, lotions, or oils on your body.
Temperature and Time: The hot tub is preset to a safe temperature (usually not
above 40°C). Do not attempt to adjust the controls. Limit each soak to 15–20
minutes to avoid overheating. Stay hydrated (drink water) while using the hot tub.
Cover and Safety: Always replace and secure the hot tub cover when not in use.
Do not allow anyone (children, animals) to go near the tub unsupervised. The
area can be slippery; walk carefully and use handrails if available. Keep all
electrical controls and plugs dry and covered to avoid any contact with water.
No Glass: Do not bring glass containers or breakable items into the hot tub area.
Use plastic or unbreakable drinkware only.
Electrical Safety: Under no circumstances should you attempt to open or
tamper with any electrical control box. If the hot tub is electric, ensure the socket
and cables remain dry and protected. If wood-fired, follow the Owner’s
instructions for fire management and do not handle hot stove parts.
Wood-Fired Specific (if applicable): Only light the stove when the water is at
least 20 cm above the heater. Do not let the water exceed 50°C. Do not use
chemicals in a wood-fired tub. Do not cook food on the fire or stove. Allow for
cool-down before covering.
Monitoring: During your stay, please periodically test the water quality as
instructed (testing strips are usually provided) to ensure the chemical balance
remains safe. If the water turns cloudy or discoloured, or any fault occurs, stop
using the tub and contact Fresh Escapes immediately.
By using the hot tub, you confirm you have read and understood these rules. Any failure
to follow them may result in injury or damage, for which you will be held responsible.
Fresh Escapes and the Owner accept no liability for injury, illness or death resulting
from misuse of the hot tub. You are liable for any damage to the hot tub or its equipment
during your stay (outside normal use wear-and-tear).
Pets
Allowed Pets: Pets (usually dogs) are allowed only at properties that are
explicitly marked as pet-friendly. The number and size of pets allowed will be
stated in the property description. If you bring a pet to a non-pet-friendly property,
or exceed the pet limit, the Owner may refuse your entry or require you to leave
immediately (treating it as a breach of contract, see Section 7).
Pet Responsibility: If pets are allowed and you bring one, you are responsible
for them. Remove all pet hair, waste and odors from the Property before
departure (inside and outside). Any damage or extra cleaning required due to
pets will be charged to you. Do not allow pets on beds or furniture. Never leave
pets unattended in the Property or yard.
Additional Cleaning: Even at pet-friendly properties, the Owner may charge an
extra professional cleaning fee if a pet has stayed, to return the property to its
original condition.
Service Animals: Registered assistance dogs are welcome even at non-pet-
friendly properties, provided you inform us in advance. However, we cannot
guarantee absence of animal allergens. You remain responsible for any cleaning
needs or damage, as above.
If you violate any pet rule, the Owner may end your stay (see Owner’s right to terminate,
Section 7). In that case you must leave, and no refund will be given.
Travel Documents and Health
It is your responsibility to ensure you and your Guests (and pets) have all required travel
documents, passports, visas, and health certifications needed for visiting the country
and region of the Property. Fresh Escapes is not responsible for any costs or losses you
incur due to lack of proper documentation or compliance (e.g. quarantine, missed
travel).
Insurance
We strongly recommend you and your guests take out adequate travel and holiday
insurance before your trip. This should cover cancellation, medical expenses, personal
injury, and theft or damage to your personal belongings. We will not be liable for any
losses (e.g. travel costs, personal property loss, injury) that insurance would normally
cover.
6. Cancellation and Changes
1. Guest Cancellation: Once your booking is confirmed, you generally do not have
a right to cancel and receive a refund (because accommodation services are
provided at a specific time). We provide the Booking Service immediately on
confirmation, so the Booking Fee is non-refundable. However, if we become
aware of a significant mistake in your booking details or charges (e.g. wrong
price) and notify you, you may cancel the booking with a full refund of any
payments (including Deposit), as long as you do so promptly. Additionally, if on
the due date the exchange-rate increase triggers a price rise of 5% or more and
we notify you, you may cancel within 14 days with a full refund.
2. Covid/Force Majeure: If you are unable to travel due to official travel
restrictions or lockdowns (for example government measures like those seen
in the COVID-19 pandemic) that directly prevent your holiday, we will give you a
choice: cancel with a refund of all monies paid (minus a 1.5% administration
charge on payments made, to cover our costs) or rebook the same booking on
alternative dates (no administration fee, but if rates differ you pay the difference
or receive a credit). This is subject to proof of the restriction and does not apply
to general travel anxiety or non-official advisories.
3. Amendments: If you want to change your booking (dates, number of guests,
etc.), you must contact us as soon as possible. Any changes are subject to the
Owner’s agreement and may incur additional charges or cancellation fees (for
example if the rental price is higher or we incur costs). We reserve the right to
charge an administration fee for changes to cover our costs.
4. No Transfer: You may not transfer your booking to another person. If you do not
stay but your Guests do, you remain fully responsible for all obligations and any
damage or charges incurred by them.
5. Owner/Property Changes: If the Owner makes significant changes to the
property (e.g. major facility removal), or circumstances make the rental
impossible, we will inform you. You can then choose to cancel (refunding all
payments) or accept an alternative arrangement if offered. See Section 7 for
cancellations by us or the Owner.
7. Cancellations or Termination by Fresh Escapes/Owners
1. Cancellation by Fresh Escapes/Owner: We (as the Owner’s agent) or the
Owner may cancel your booking before arrival in limited cases, such as: health &
safety issues at the Property, legal/policy termination of our agency for the
Property, or major unexpected changes. An Owner may also cancel due to
events outside their control (e.g. natural disaster, strike). If we or the Owner
cancel, we will attempt to find you alternative accommodation of similar standard
or refund all monies you have paid (unless you accept the alternative). We will
not be liable for any costs of alternative arrangements, but we will try to minimise
inconvenience.
2. Owner’s Right to Terminate (during stay): The Owner may require you and
your Guests to leave immediately (and treat it as contract termination) if:
You breach any of your obligations (see Section 5);
You break the pet rules (Section 5);
You fail to pay any required deposit or fee when due;
Force majeure (events beyond control) makes your stay unsafe or
impossible.
In such cases, you must leave at once. No refund of the booking fee or
rental payments will be made (except possibly unused balance if the
property is re-let, at the Owner’s discretion).
3. Consequences of Termination: If the Rental Contract ends before or during
your stay (for any reason above), you and your Guests must leave immediately,
return the keys as instructed, and notify us and the Owner that you have
departed. Your statutory rights as a consumer are not affected (see Section 10).
We may keep any sums paid (except as required by consumer law) to
compensate the Owner for loss of rental and to cover any damage.
8. Liability
Our Liability: We are obligated to provide our Booking Services with reasonable
skill and care. We do not exclude liability for death or personal injury caused by
our negligence, or for fraud. However, to the fullest extent permitted by law, we
do not make any other promises about the Property or services. We are not
responsible for: any inaccuracy or error in the property descriptions or photos
(these are provided by the Owner); any interruption or delay in the Booking
Service due to technical issues; or any issues arising from the Owner’s
performance. We will not be liable for any indirect losses (like business losses,
lost profits, loss of enjoyment, etc.). We are not responsible for any injury or loss
to you or your belongings during the holiday, except to the extent caused by our
negligence.
Owner’s Liability: The Owner is liable to you under the Rental Contract for
providing the Property and services with reasonable care. Owners cannot limit
their liability for death or personal injury due to negligence, fraud or breach of
statutory rights. However, Owners may similarly disclaim liability for indirect or
unforeseen losses. We are not responsible for the Owner’s obligations, so any
claim about the Property itself should be addressed to the Owner.
No Packages: These bookings are not considered “package holidays” under UK
regulations, as we only provide accommodation and no travel or tours. This
means some holiday package consumer protections do not apply.
Foreseeable Losses Only: If we or the Owner breach the contract, we are only
liable for losses that were reasonably foreseeable at the time of booking. We
accept no liability beyond that, except as required by law.
Your Belongings: Your personal property, vehicles, and valuables left at the
Property (including in garages or storage) are at your and your Guests’ own risk.
We strongly advise you to remove or lock away valuables and to insure against
theft or damage. We accept no liability for loss, theft or damage to personal
belongings, unless caused by our or the Owner’s negligence.
Assistance Animals: We are not liable for any health issues (e.g. allergies)
caused by other guests’ assistance animals. We take no responsibility for the
behavior or safety of any pet or assistance animal that may stay at the property.
9. Privacy, Cookies and Marketing
Privacy & Data Use: We process your personal data in accordance with UK
data protection law (UK GDPR). Please see our Privacy Policy for details on how
we collect, use, share, and protect your information. By booking with us, you
consent to this use, including sharing necessary information with the Owner to
provide the rental. You also consent to transactional emails from us (e.g. booking
confirmations, payment receipts).
Cookies: We use cookies on our Site to enable the booking process and
improve your experience, as described in our Cookie Policy. By using the Site
you agree to our cookies. You can disable certain cookies via your browser, but
this may affect functionality.
Marketing Communications: We may invite you to consent to receive
marketing from us (newsletters, special offers, etc.) by email or telephone. If you
opt in, we will use your contact details for this purpose. You can unsubscribe or
withdraw consent at any time by clicking the unsubscribe link in an email or
contacting us. Our lawful basis for marketing is your consent (or, in limited cases,
legitimate interest where consent is not required). We will never share your
details with third-party marketers without permission.
10. Complaints
During Your Stay: If you have any issue with the Property or the Rental Services
while staying, please contact the Owner (or their local agent) first to see if it can
be resolved immediately. You should also notify Fresh Escapes so we can assist.
After Your Stay: If you remain dissatisfied, notify us in writing with full details of
your complaint and any response from the Owner, within 7 days after your
departure. Send this to our contact email. We will use reasonable endeavours to
liaise with the Owner to address the problem.
Consumer Rights: This complaints procedure does not affect your legal rights
as a consumer. You may seek advice from Citizens Advice or Trading Standards,
or pursue other dispute resolution if needed.
11. Additional Terms
Communications: Any notices or communications under these terms may be
given electronically (e.g. email). Communications to us may use the contact
details below.
Language: The official language of this contract is English. If translated, the
English version prevails.
Modifications: These terms may be updated by Fresh Escapes at any time.
Changes will be effective 7 days after we email you or post revised terms on our
Site. Your continued use of our services after that date implies acceptance of the
new terms. Confirmed bookings will continue to be governed by the terms in
effect at the time of booking. No staff or agent has authority to vary these terms
without written confirmation from us.
Assignment: We and the Owner may transfer our rights and obligations under
these terms to another party (for example, if the management of a property
changes). If we do so, we will notify you and you can end the contract within 14
days (with full refund of sums paid). You may not assign your booking to anyone
else without our written consent.
Third-Party Rights: Only you, Fresh Escapes, and the Owner are parties to the
contracts made under these terms. No other person has any rights to enforce
them.
Severability: If any term is found illegal or unenforceable by a court, the
remainder of these terms remain in force.
Waiver: If we or an Owner delay in enforcing any right under these terms, it does
not waive that right.
Force Majeure: Neither Fresh Escapes nor the Owner is liable for failure to
perform due to events beyond their reasonable control (e.g. natural disasters,
war, industrial action, government restrictions, power failures).
Governing Law: These terms and any contracts under them are governed by
the laws of England and Wales. You may bring proceedings in England and
Wales, or (if you live in Scotland or Northern Ireland) in those jurisdictions
respectively.

Assumptions
These terms assume that bookings are for accommodation only (no transport or
tours).
“As quoted at booking” means actual deposit or waiver amounts will vary by
property and are set out in your confirmation.
Damage Waiver covers only accidental damage up to the stated limit; intentional
damage, theft, and personal injury are excluded.
The 7-day refund timeline for deposits assumes prompt property inspection and
no disputes.
The administrative (1.5%) fee on refunds for COVID-related cancellations is
assumed based on user instructions; actual fee may be set by Fresh Escapes.
The company reserves the right to update fees and terms; we assume payment
methods (cards, bank transfers) remain available.
Guesty references have been omitted per instructions; all policies are under
Fresh Escapes’ management.
Current UK law (as of 2026) governs these terms; we assume no contrary local
regulations override the above provisions.
